Golf Course Terms and Conditions
(Application of These Terms and Conditions)Article 1
- Members and visitors (hereinafter referred to as “Guests”) using The Atta Terrace Golf Resort (hereinafter referred to as the “Golf Resort”) shall comply with the rules established by the Golf Resort, the Rules of Golf as prescribed by the Japan Golf Association, and these Terms and Conditions for Use, so that all Guests may enjoy safe and comfortable play.
Article 2
- Guests using the facilities must complete the following registration procedures at reception at least 30 minutes before their start time on the day of use. Upon completion of these procedures, the Golf Resort shall be deemed to have accepted the Guest’s use of the facilities.
- 1) Guests shall complete registration by entering their name, address, and any other matters deemed necessary by the Golf Resort in the prescribed register.
- 2) Responsibility relating to the use of the facilities shall commence when the registration described in the preceding paragraph is completed and shall end upon settlement of the usage fees.
- 3) The Golf Resort shall bear no responsibility whatsoever for any accident arising from a Guest’s failure to comply with these Terms and Conditions.
Article 3
- Usage fees shall, in principle, be paid on the day of use by cash or credit card.
Article 4
- The following provisions shall apply.
- 1) If a Guest suspends play at his or her own discretion or for personal reasons, the regular fee shall be payable.
- 2) If the Golf Resort requests the suspension of play due to severe weather, lightning, or similar circumstances, the following fees shall be payable.
- 1. If 1 to 8 holes have been completed: Free of charge
- 2. If 9 to 17 holes have been completed: Half of the regular fee
- 3) Even if a Guest suffers damage as a result of cancellation of use or suspension of play pursuant to the preceding article and the preceding paragraph, the Golf Resort shall not be liable to compensate the Guest for such damage.
Article 5
- The Golf Resort may refuse use of the facilities, or continued use thereof, in any of the following cases:
- 1) When no reservation has been made for use of the facilities.
- 2) When an application has been made under a false name or in another person’s name.
- 3) When a person is intoxicated or has tattoos on his or her body.
- 4) When a person is deemed to be involved in criminal acts, a habitual offender, or affiliated with an organized crime group.
- 5) When a person’s skill is deemed to be clearly insufficient and likely to hinder the progress of other players.
- 6) When a person has failed or refused to pay usage fees, cancellation fees, or other charges.
- 7) When a person engages in attire or conduct that damages the reputation of the Golf Resort, disturbs order, or is contrary to public morals, or when such risk is deemed to exist.
- 8)When the facilities are closed due to weather, poor conditions (storms, lightning, etc.), or other unavoidable circumstances.
- 9)When a person violates the rules established by the Golf Resort or these Terms and Conditions, or when use of the facilities is deemed inappropriate for any other reason.
Article 6
- Guests must follow the instructions of employees in order to proceed with play safely and comfortably.
Article 7
- The handling of Guests’ money and other valuables shall be as follows:
- 1) Money and other valuables must be deposited at the front desk.
- 2) The Golf Resort shall bear no responsibility whatsoever for any loss arising from storage by any method other than that described in the preceding paragraph.
- 3) Lost property found within the facilities shall be handled in accordance with applicable laws and regulations.。
Article 8
- The Golf Resort shall bear no responsibility whatsoever for theft, damage, or other loss involving automobiles or items left inside vehicles in the parking area.
Article 9
- Guests must ensure that lockers are locked before use. The Golf Resort shall bear no responsibility whatsoever for damage to or loss of items stored therein. If deemed necessary by the facility manager, lockers may be opened and inspected.
Article 10
- Guests shall be responsible for all of their actions during play. Guests must observe etiquette, manners, and rules, and play at their own discretion and responsibility. Any injury to themselves during play, damage caused to other Guests, or damage caused to facilities or other property shall be resolved at the Guest’s own responsibility.
Article 11
- Practice swings with clubs must not be made except within the tee box where tee markers are located or in designated areas. Guests other than the player striking the ball must not enter the tee box without due reason.
Article 12
- Guests must be aware of their driving distance, confirm safety, and take care never to hit into the group ahead.
Article 13
- Companions must never stand in front of the player. They must also pay close attention to the struck ball and endeavor to avoid danger.
Article 14
- If a ball is hit into an adjacent hole, the Guest must pay sufficient attention to the Guests playing that hole and to his or her own companions, and carefully strike the ball so as not to interfere with play.
Article 15
- The following provisions shall apply.
- 1) When allowing the following group to play, Guests in the preceding group must retreat to a safe place until all players in the following group have completed their shots.
- 2) After completing the hole, Guests must immediately leave the green and proceed to the next hole by passing through a safe area for the players in the following group.
- 3) In the event of thunder, Guests must immediately suspend play and evacuate to a place considered safe.
Article 16
- The Golf Resort operates using five-passenger golf carts. Guests must strictly observe the following matters and follow employee instructions to operate carts safely.
- 1) As a general rule, carts shall be driven by employees; however, in the case of self-play rounds or similar situations, a person holding a motor vehicle driver’s license must drive the cart.
- 2) Carts must be operated within the prescribed passenger capacity.
- 3) Guests must pay attention to etiquette and manners and avoid driving in a manner that interferes with other Guests.
- 4) The Golf Resort shall bear no responsibility whatsoever for accidents caused by a Guest’s intentional act or negligence.
Article 17
- The use of fire on the course and in any facility area is strictly prohibited except in designated locations. Burned matchsticks and cigarette butts must be fully extinguished and placed in ashtrays.
Article 18
- Guests must personally check their golf equipment and other belongings before starting play and after finishing play. The Golf Resort shall bear no responsibility whatsoever for any loss, damage, or other issue.
Article 19
- If a Guest causes damage to facilities or other property intentionally or negligently, the Guest shall pay for such damage. The same shall apply if a Guest takes facility equipment or other items outside the premises.
Article 20
- Bringing the following items into the facilities is strictly prohibited:
- 1) Pets.
- 2) Items emitting offensive odors.
- 3) Firearms, swords, and similar weapons.
- 4) Gunpowder, volatile oils, and other items that may ignite or explode.
- 5) Items that may cause excessive noise.
- 6) Any other items considered dangerous.
Article 21
- The following acts are strictly prohibited within the facilities:
- 1) Entering the course before the start time or after completion of play.
- 2) Collecting plants or animals.
- 3) Entering restricted areas.
- 4) Gambling or any other acts or speech contrary to public morals.
- 5) Acts or speech that cause inconvenience or discomfort to Guests or employees.
- 6) Sale of goods or advertising and promotional activities (except where permitted by the Golf Resort).
- 7) Entry onto the course by persons other than users (except where permitted by the Golf Resort).
- 8) Photography, audio recording, or similar activities (except where permitted by the Golf Resort).
Article 22
- The Golf Resort will assist with the handling of courier deliveries of golf equipment and similar items, but shall bear no responsibility whatsoever for any loss or damage.
Article 23
- The Golf Resort shall handle personal information pursuant to Article 2 and usage history arising from use of the Golf Resort (including number of visits and purchase history), etc., in accordance with the separate “Privacy Policy.”
Article 24
- The following provisions shall apply.
- 1) The Golf Resort may amend these Terms and Conditions at the Golf Resort’s discretion in the following cases:
- 1. When the amendment of these Terms and Conditions conforms to the general interests of users.
- 2. When the amendment of these Terms and Conditions is not contrary to the purpose of the agreement and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances relating to the amendment.
- 2) When the Golf Resort amends these Terms and Conditions pursuant to the preceding paragraph, it shall disclose the fact that these Terms and Conditions will be amended and the content of the amended Terms and Conditions, as well as the effective date thereof, before the amendment becomes effective.
- 3) If a user uses the Golf Resort on or after the effective date of the amended Terms and Conditions, the user shall be deemed to have agreed to the amendment of these Terms and Conditions.
- 1) The Golf Resort may amend these Terms and Conditions at the Golf Resort’s discretion in the following cases:
Article 25
- Any matters not stipulated in these Terms and Conditions, the rules established by the Golf Resort, or other Rules of Golf shall be resolved in accordance with the principles of good faith and sincerity, in keeping with the spirit of the game of golf.
